Dowdey & Associates 16250 Dallas Parkway Suite 100 Dallas, Texas 75248-2684 Re: Heartz Road Extension Gentlemen: I am writing this letter for the purpose of advising you that the Parks of Coppell Trust, which is the owner of the land on the west side of the newly-completed Heartz Road extension, has no objection to the fact that the location of the road cuts across an old creek bed running generally in a northeasterly direction to a point where it intersects the Heartz right-of-way approximately 400' north of Sandy Lake Road. It is my understanding that the construction across the old drainage way has been performed in such a manner that there is a positive overflow under heavy run-off conditions into the Heartz Road drainage system. At the present time, this creek is located in a heavily wooded area which is uninhabited and unutilized for anything other than agricultural purposes. We are in the process of discussing the development of this area with prospective residential developers. When a development takes place on this property, this minor drainage blockage would be corrected at that time. This letter shall also serve to grant our permission for Allen Property Corporation or its agents to enter upon that portion of the Trust property around the small pond on the west side of the Heartz Road drainage structure for the purpose of performing limited grading in that area so that the drainage across the Trust property flows into the pond, and from there on into the box culvert, provided that the work is performed in such a way that our agricultural user will continue to be able to utilize the pond for his livestock.
