I am attaching two documents from the file concerning the construction of Ruby Road. One document is a fax sent to our office from Duke personnel and includes both a USGS map and a "National Wetlands Inventory Map". Both of these maps show the pond located on our property north of Ruby Road. The second document is a "wetland determination report". This document includes maps and pictures in and around the pond as it existed in 2001. Based on these documents I can not support the position of Pacheco Koch that the pond and dam have been created since the Container Store was built. I have however visited the site, and I did observe evidence of beaver or nutria activity that could have contributed to an increase in height of the dam, and a resulting higher water surface. Any increase in water surface elevation in our pond could directly impact the Container Store pond. I do agree that the options for correcting the issue the Container Store is concerned with include removal of a portion of our dam, or inserting a pipe through the dam at an acceptable elevation to drain off the excess water. Both of these options will reduce the volume and size of our pond. As I understand it, the future cemetery expansion includes incorporating this pond into the layout as an amenity. I would not want to do something that would hinder that future effort. The cemetery engineering has been done by Mike Daniel with Nathan Maier Engineering. Perhaps we should ask him to look at the situation and make some recommendations that would protect our future interests as well as address the concerns of the property owner to the south.
