The wall was placed based on the NCHRP (National Cooperative Highway Research Program) Report 537 which recommends 8' between guardrail/barriers and curb for speeds less than 45 mph (Bethel Road). This alignment, however, does push the outside footing (footing on backside of wall) into private property for approximately the first 55' of the North retaining wall until Mr. Pajares ROW line turns due north (approx STA 37+64). It's something I should've identified when the wall was changed from an MSE wall to a CIP wall. The initial wall design using an MSE wall has a much smaller footing. By using the CIP wall, there is an overlap. If the wall was relocated to omit this overlap, there would be an approximate 2-3' offset between Mr. Pajares existing screening wall and the proposed retaining wall and we would not meet the NCHRP recommendation. Will Mr. Pajares have concerns about this offset? Do you think he would be agreeable to a 55'x3' structural easement in order to eliminate the offset? Sorry this was not identified earlier.
