Keith,
As we also discussed this morning, to get in and saw out a footing and
try to remove this adjacent to the existing trees will be a greater task
than what is shown on your attached mark up of the change order. Saw
cutting a 2' piece and removing it in the area of the trees and roots is
more of an undertaking than that and the cost will not be the same. We
are not just cutting a curb on the street in the wide open area. Since
it has been determined that a portion of the footing is on Mr Pajares
property, we need to find out the following information:
Can the footing stay and the revised footing be installed on top of it
per the plan given to us by Freese-Nichols?
I still need to be paid for the footing installed after fix has been
installed, per corrections.
When are we going to get the revised plans for the new location of the
wall so that the new footing repair can be placed in the correct
location?
The footing will be installed on top of the existing footing, per detail
given and will bill for the wall according to the contract.
If there is no removal to the footing and repairs are made per the
detail given by Freese-Nichols then the change order is something that
is no longer a discussion, but if the removal of the 2' of footing is
something that has to be performed, this change order will be revised to
be compensated for the sawing and removal of the necessary footing in
the small area that you will be requiring to be removed. Please let me
know what it is the City of Coppell would like done in this area.
We have ordered steel to make necessary corrections to the footings and
existing walls poured. The steel is to arrive on Friday and will be set
up for inspection and pour on Tuesday, next week. I would like to get
this north wall resolved this week since we have been discussing it
moving around and changes since before June 28th and still have no
resolve.
Please let Mr Pajares that the direction we need to go is to leave
existing footing in place so no additional damage occurs to his trees.
We will then install the footing on top of the existing footing and
install per plan once we have received the plans with the new location.
At this point his encroachment issue will be resolved, the backfill can
be performed, and the trees live.

Dean,
As we discussed this morning the city does not feel it is appropriate to
compensate JRJ for the full value of the footing placed. We base this
on the fact that the footing was improperly constructed and is not
useable for its intended purpose. Whether the encroachment was there or
not, the footing would need to be replaced. The design engineer, at no
cost to JRJ, has designed a wall that can be built while leaving the
improperly constructed footing in place.
It is our position that we are now discussing the cost of removing that
portion of the footing that encroaches Mr. Pajares property, rather
than the value of the footing itself. I have marked up the change order
and attached it below indicating removal of an average 2 feet of
footing. The new footing can then be formed and poured on top of the
existing one at the appropriate location to prevent further
encroachment. If in JRJ's opinion it is faster or easier to remove the
entire footing they may do so at no additional cost to the city.
I have also placed a call to the property owner to see if they would
prefer to leave the concrete where it is to minimize any more tree
damage. In the event no removal takes place, there will be no
compensation from the city.

I need to know if the attached change order has been approved to remove
the existing wall off of Luis's property. If so, I will also need a
revised set of plans showing the new location of the wall so I can get
it staked and reinstalled in the correct location. We are trying to get
the steel ordered and move forward on the wall repairs. The goal is to

get the entire north wall poured by the end of next week, but to
accomplishing this, I need this last 62' resolved so that we can get
this area removed and the necessary steel ordered, installed, and
footing poured back.

The Contractor has requested a change from the cement treated flex base backfill to flowable fill behind
the abutment. In my professional opinion, the intent of the original requirement is met by this substitution
because the CLSM (Controlled Low Strength Material or flowable fill) is less prone to long term settlement,
just like the CTFB (Cement Treated Flex Base). I will call Keith shortly to explain our position.

From a structural standpoint this will be an acceptable substitute in lieu of the cement treated base as
shown on plans. We make this approval with the understanding there will be no change in the unit cost for
Bid Item #204.
Please resubmit this mix design at a 100 PSI min and we will review and approve accordingly.
