STEP-WISE PLAN FOR ROAD ASSESSMENT DISTRICT ON BELTLINE
NORTH/SOUTH FROM 635
I. CIVIL STATUTES
A. Council decides the need, orders, contracts, and
provides for payment of the road improvement.
B. City determines the time, terms, condition of
payment, and default terms of assessments.
C. The Governing Body will prepare an estimate of the
total Improvement costs assessable to the abutting
owner(s).
D. Assessments are:
1. a first/prior lien and a personal liability
2. based on the FRONT FOOT PLAN and liens are not
placed on property with exemptions at the time of
ordering of the improvement
3. made after a public hearing
a. hearing notices are advertised 3 times
beginning 21 days prior to the occurrence
b. property owners are notified 14 days prior
c. railways and street railways are notified in
the same manner
II. CITY ORDINANCE
A. Street Assessment Policy
1. Improvements comprised of paved surface, curb,
gutter, sidewalks, and driveways
2. Owners assessed for 90~ of 1/2 of width of
street, 100~ of 1/2 of drainage, and 100~ of
sidewalks
B. Payment Policy
1. samt-e/lnual installments (no more than 8)
2. the first payment due within 30 days from
completion date after acceptance by City
3. other payments at 8~ per ~/%nu~ or the rate
payable by the City on its most recently Issued
general obligation bonds
4. any owner ~a¥ p~¥ the total charge to him
without interest within 30 days after the
acceptance of completed work
C. Conflicting ordinances are repealed. Violators of the
repealed ordinances prior to the effective date of
this ordinance are still punishable.
D. The whole of this ordinance is still valid even with
one part being determined invalid.
E. Kffective date - immediately from date of passage.
