I have talked to Mindi regarding the nature of the agreement between Duke and The City of Coppell, and I
understand all of the findings regarding the necessary maintenance on the pond. The request is that the
maintenance recommended be completed sooner rather than later, because in the interim The Container
Store does not like the condition of the pond. The pond has a huge ring of dirt because when the water
level rose and stayed longer than previous years it killed all of the grass. They would like this area to be
seeded. Seeding would be pointless if the next rain will kill all of the grass. If this issue is resolved in late
summer/early fall then it would be too late to seed. The ring would be there until next spring when the
weather would allow proper seeding...

I have reviewed the attached letter from Jack Evans at Pacheco Koch as it relates to the pond on city
owned property north of Ruby Road. For clarification purposes, the pond on city property pre-dates the
construction of Ruby Road and the Duke development to the south. I have attached a copy of the 1959
USGS map that clearly indicates the existence of the pond.
The city intends to incorporate this pond into the cemetery as an amenity during phase 2 of the
development. At that time the pond will likely be improved from an aesthetic and an operational
standpoint. In the interim, we will implement one of the recommended measures from Mr. Evans' letter.
City staff will schedule this work for sometime over the summer while the water level is at it's lowest.
