GAO investigation says:
EPA needs to issue additional stormwater regulations
In 2006 the Government Accountability Office conducted an investigation to
G A 0 evaluate and determine the overall cost and burden of implementing a Phase
Accountability * Integrity *Reliability II stormwater program in a small community. The GAO surveyed all 50 states
and collected sample information from 130 communities. In May 2007 they
delivered their results to the Senates Environment and Public Works Committee. The GAO found that "any
assessment of program burden will be hampered by limited and inconsistent data" and as a consequence
of this they were requesting that the EPA "issue guidance and consider regulatory changes" requiring
communities to more thoroughly track and report cost information. Furthermore the GAO stated that "EPA
will find it challenging to meet its goal to examine Phase II implementation starting in 2012." It appears
more changes are coming for your stormwater program.
One of the biggest burdens, and the one least discussed by regulators, is how to manage your program so
that you can (1) demonstrate you are complying with all program requirements, (2) pass a program audit
and (3) create your annual reports. If you cannot do these three things then all of your other efforts will be
for nothing. In short the way the stormwater program works is that you have to prove that you are in
compliance otherwise you are out of compliance. Being out of compliance may subject you to civil and
administrative fines. As reported in June 2006: "The City of Dallas has agreed to entry of a consent decree
requiring it to spend $3.5 million to upgrade its stormwater system. The city will also pay an $800,000 fine,
and will be subject to continuing monitoring by EPA." Is this what you want? We didn't think so.
