Re: THURSDAY MEETING ON THE RELOCATION
OF BELTLINE ROAD
Dear Mayor and Council:
As you are aware, Councilman Ware and myself held a meeting with the
representatives of the various land owners concerned with the Beltline
Road Relocation Issue. Those present were as follows:

Attached, you will find a copy of the Issues that were discussed at
yesterday's meeting. After lenghty discussion on the major areas of
safety and costs, we moved into a discussion on possible compromises.
Some of the alternatives suggested are as follows:
1) A land swap between Riverchase and Triland creating frontage
on the relocated Beltline Road for both parties.
2) A split roadway (eastbound traffic located in the relocated
route and westbound traffic located in the existing route).
3) Crow Billingsley offered a 5 acre site on their property to be
used as a Marketing Center for Terra to give them additional
exposure to the relocated Beltltne Road.
4) Triland offered to sell a corner of the MacArthur/Beltline
Intersection to Riverchase at Triland's Proforma Values.
After discussion of each of these potential compromises, it became
evident that all parties involved were not willing to accept any of
these alternatives.

The final resolution of this issue, as it always has, lies with the
City Council of Coppell, Texas. In my opinion, based on yesterday's
meeting and the discussions that took place at that meeting, the major
deciding factors in this decision are as follows:

All parties at the meeting yesterday agreed that in either
location, the roadway could be engineered to be a safe road.
Based on Wayne Ginn's Cost Estimates and Assessment Program,
the City can not afford to build the section of Beltline Road
under discusion in either the existing route or the relocated
route. Under the existing route, the City will have to pay
$2,024,400 out of pocket plus $566,288 for landscape, lighting
and signals and under the proposed relocated route, the City
would have to pay $622,000 plus $570,076 for landscape, light-
ing and signals. This assumes the assessment of the property
north of the railroad under the existing alignment alternative.
Attached, you will find copies of letters from Triland and Crow/
Billingsley Company committing to the dedication of the Relocated
Beltline Road right-of-way, the donation and dedication of streets
providing access to adjacent property owners and the agreement to cost
participation in constructing the Relocated Beltline Road. Addition-
ally, there is a letter from Jack Huffman, City Manager of Irving,
indicating that the Irving City Council will be reviewing Triland's
request for Dis-Annexation of any areas of the Relocated Beltline Road
from the City of Irving. I also understand that Mayor Duggan has
received a letter from the Riverchase Partners regarding their commit-
ments on this matter. As of the date of this letter, I have not
received a copy of their letter.
There were several questions ask of Wayne Ginn's Assessment Program and
Cost Estimates. I have addressed those questions with Mr. Ginn this
morning and expect him to have answers at tonight's Council Meeting.
In summary, both Dale and myself and the landowners involved feel that
yesterday's meeting was beneficial from the standpoint of addressing
the Issues in a more relaxed enviornment and all feel that the time spent
was worthwhile. However, there was no compromise developed between the
landowners. And, as stated previously, it is up to us to make a final
decision tonight. I urge each of you to vote based upon the Issues and
the Facts and not upon any political pressures or upon the personalities
involved.

B. Estimates of Cost on Alternative Alignment.
C. Review of Ginn, Inc's. Assessment Program.
D. Voluntary Assessments.
E. Cost of Street Lights, Signals and Landscaping.
F. Acquisition of ROW.
G. Construction of North/South Extensions of Mockingbird, MacArthur,
Fairway and Ledbetter, including any needed bridges. (Need for
Excrow of Funds to insure completion).
H. Dedication of Alternative Alignment ROW and Abandonment of
Existing ROW.
I. Need for Gross Cost of Project to be available before awarding
Contract.
III. ACCESS TO LAND OWNERS NORTH OF EXISTING BELTLINE ROAD:

Gentlemen:
It is my understanding that you were appointed during the
Special City Council Session on March 31, 1986 as representa-
tives for the City Council to attend a meeting of all landowners
affected by the proposed realignment of Belt Line'Road. Further,
it is my understanding Mr. John Bailey shall serve as moderator
at that meeting; that the meeting shall be open to the public;
and, finally that the only individuals allowed to speak or parti-
cipate in the meeting other than yourselves are the designated
representatives (one each) for each of the affected landowners,
Listed below are individual points affecting both Crow/Billingsley
Company and property owners on the north side of the railroad
based upon representations made by Crow/Billingsley Company
in each specific case. The representations stated below are intended
to be binding upon Crow/Billingsley Company and its successors or
assigns.
Belt Line Road Ri~lht-of-Wa¥
Crow/Billingsley Company is currently the owner of the property
from just west of MacArthur Boulevard extending to the west to the
property owned by the Power Company. As managing partner of
the above described property, I am authorized to hereby warrant
that in the event Belt Line Road is realigned to the south, we would
grant title to the proposed 120' right-of-way to the City of Coppell
or Dallas County as required. This grant of right-of-way is
subject to an exchange for existing Belt Line right-of-way adjacent
to our property and to the proposed realignment allowing for
developable land on both sides of the realigned roadway.
Based upon conceptual plans already submitted to both the City
and County, it is anticipated that the amount of land involved in
this exchange would be almost identical with the current Crow/

Billingsley Company property, in the unlikely event that Crow/
Billingsley Company would gain additional land in the exchange,
we would be prepared to compensate the City of Coppeil for this
additional land at the then fair market value.
Access to Adjacent Property Owners
When the proposed realignment was initially approved by the
City Council, it was with the stipulation that access would be
provided to-property owners currently possessing access to Belt
Line Road. In addition, this access would be granted in such a
way as to be out of the 100-year floodplain. Crow/Billingsley Com-
pany hereby represents that is will grant to the City of Coppeli or
Dallas County a 50' wide right-of-way from the southern right-of-
way line of the St. Louis and Southwestern Railroad to the northern
right-of-way line of the realigned Belt Line Road for the extention
of Mockingbird, including the construction of a bridge over the
creek at our expense.
The dedication of the above-mentioned rights-of-way would only
be contingent upon the approval of the crossing by the St. Louis
and Southwestern Railroad, and construction of the crossing by
others, where such road crosses our property.
Cost Participation
As represented previously, Crow/Billingsley Company hereby agrees
to pay for the construction of a concrete roadway for Mockingbird
from the south right-of-way line of the St. Louis and Southwestern
Railroad to the north right-of-way line of realigned Belt Line Road.
It is anticipated that these roads would have a paving section of 6",
3000 p.s.i, concrete.
Finally, Crow/Billingsley Company hereby agrees to participate in a
mandatory or voluntary assessment program to contribute to the
cost of improving Belt Line Road along its realigned route subject to
only the following conditions:
(1) The assessment relate only to the linear frontage of developable
land,
(2) All private property owners having Belt Line frontage participate
in any mandatory assessment program,
(3) Any mandatory assessment program be uniformly administered.
We will be prepared to discuss theses and any other issues at the
April 3 meeting. We appreciate the interest of the City Council in
causing this meeting to occur and look forward to a resolution of

of any outstanding unresolved questions. Again, this letter is
intended to be binding. Should you or the City Council require
any additional documentation or require that this letter be in a

of the above-described property, we are authorized to hereby
warrant that in the event Belt Line Road is realigned to the
south, we would grant title to the proposed 120'
right-of-way to the City of Coppell or Dallas County as
required. This grant of right-of-way is subject to an
exchange for existing Belt Line right-of-way adjacent to our ~

Based upon conceptual plans already submitted to both the
City and County, it is anticipated that the amount of land
involved in this exchange would be almost Identical with
Triland/Northsted, however, granting approximately one-
quarter of an acre more land than it would receive in
return. This additional acreage would be dedicated without
compensation. In the unlikely event that lriland/Northsted
would gain additional land, we would be prepared to
compensate the City of Coppell for this additional land at
the then fair market value.

City Council, it was with the stipulation that access would

the St. Louis and Southwestern Railroad, and construction of
the crossing by others.

As represented previously, Trtland/Northsted hereby agrees
to pay for the construction of a concrete roadway for both
Fairway Drive and Ledbetter Road from the south right-of-
way line of the St. Louis and Southwestern Railroad to the
north right-of-way line of realigned Belt Line Road. It is
anticipated that these roads would have a paving width of
)1' back-to-back and a paving section of 6", )000 p.s.l.
concrete.
In addition to the above, Triland/Northsted hereby agrees to
pay for the cost of the aesthetlcal improvements to the
MacArthur Boulevard intersection required by the City of
Coppe11 Streetscape Ordinance and to construct a landscaped
entry feature along the realigned Belt Line ~oad at the City
limits of the City of Coppell. ~,J

Your March 31, 1986 letter to me requesting City of Irving
consideration of the realignment of Belt Line Road in Coppell
and Carrollton just north of the present Irving city limit
has been received. The schematic provided is in conceptual
form and, of course, proper legal descriptions will be
required for our official review.
Only the Irving City Council can make the final determination
regarding your request. Your proposal is currently under
review and will be scheduled for City Council Work Session
review at their April 23, 1986 Work Session.
During our review process, we may have need for additional
information and will let you know as necessary.
