TEXAS 7521(~ March 18, 1986 The Honorable Lou Duggan Mayor of Coppell c/o Western Capital Corporation 14755 Preston Road, Suite 625 Dallas, Texas 75240 Dear Mayor Duggan: Herewith returned are both counterparts of the proposed Roadway Easement to cover the MacArthur Blvd. crossing in Coppell. As discussed in our telephone conversation of March 17, we are agreeable to the change in Item 15, but not the changes in Items 12 and 16, detailed as follows: Item 12. Our estimated cost to install the crossing, as per Item 12, is $182,732. Ordinarily, the contingencies included in the estimate will cover any overrun not expected. We do not expect the cost to exceed the estimate. In order to include "not to exceed" wording in the agreement, we will require adding 20% to the estimated costs. Item 15. We can accept the wording "Railroad shall use its best efforts to complete its work herein described by June 17, 1986." Please understand our ability to complete work by a given date is contingent not only upon our actions, but also the City's contractor, and completion of any protection work required by the two pipeline companies involved. Item 16. It has been our understanding that the two existing crossings immediately west of the location of MacArthur Blvd. were to be closed upon completion of MacArthur Blvd.; in particular, the Allen Road crossing at Milepost 606.28 and the stable crossing at Milepost 606.49. We must insist closing of both crossings remain in the agreement. I ~ave inserted revised pages 1 and 2 of the insert, reflecting these items. If acceptable to the City, please initial the two changes in Items 12 and 15 and' return as soon as possible. Mayor Lou Duggan March 18, 1986 Page Two As we discussed, it would be advantageous to arrange a meeting of all parties involved in the construction to determine what is required of each party to meet the schedule. Also since the City has approved future relocation of Belt Line Road approximately 500' to the South, the effect on the crossing, and the interim measures taken, need to be discussed.
