Staff has reviewed the above referenced letter from Mike Allen and
would like to offer the following comments concerning Mike's
request regarding oversized and prorata utility reimbursement.
Staff does recognize that there is some equity to Mr. Allen's
request, however is not able to support his recommendation as it is
not consistent with the City's Subdivision Ordinance or other
cities' policies concerning prorata. Mr. Allen is eligible for
reimbursement of oversized utilities of 10" and larger in
accordance with the present Subdivision Ordinance.
With regard to the revision of the Subdivision Ordinance, staff
plans to recommend doing away with prorata assessments for
water/wastewater. This is due to the implementation of the impact
fee ordinance as well as other proposed changes which recommend
that the developer be required to put in utilities up to 12" before
being eligible for oversize reimbursement.
Additionally, it is our understanding that the Finance Department
would have a difficult time trying to keep up with this agreement
as it relates to reimbursement because of the number of properties
which would be affected.
The other areas of the letter from Mr. Allen have already been
addressed to him. Staff will prepare a letter by December 10, 1990
informing Mr. Allen of its review unless we hear from you
otherwise.
