RE: PARK PLACE AND HEARTZ ROAD IMPROVEMENTS
Dear Mr. Allen:
Based on a series of telephone calls beginning on Wednesday, September 26,
and continuing on Friday, September 28, Tuesday, October 2, 1990, and
including additional conversations with Gary Sieb, Steve Goram, Howard
Pafford and others, I have included below a point-by-point discussion of
issues you brought up in your August 27 and 31 correspondence to the
City. You have also received a letter from me dated September 20, which
included erroneous fee information which was discussed in a September 28
telephone call with Gary Sieb. Mr. Sieb apolo§ized for that inaccurate
fee data and your September 20 letter to us reflects the correct fees.
Now to address your earlier correspondence of August 27, 1990, beginning
with page 3:
1. The preliminary/final plat for Park Place, and the final plat
approval of Heartz Road are valid. Necessary signatures from ABQFSB
will be required before the Heartz Road plat can be filed for
record. I understand that plat has now been filed.
2. Our legal counsel advises us that the original agreement between
Parks of Coppell Joint Venture II and the City (Article 4, paragraph
2E of that agreement) requires dedication, does not require
assessments for improvements.
3. (Your second 2) Public Works reviewed your engineering plans for
providing sewer and drainage services to Park Place. The attached
Public Works memo dated October 4, outlines fee obligations.
4. (Your 3) As you are aware, Dowdey/Heartz Road plans are under review
and will be completed this afternoon. The M.U.D. has requested to
review construction plans as they relate to where the Park Place
development connects to the proposed new sanitary sewer line to be
constructed in Heartz Road, and where the new connection will be made
into the M.U.D. system.
5. (Your 4) As clarified by Council, the prevailing water and sewer
impact fees will be assessed and the water impact fees will be
collected at the appropriate time. Sewer impact fees will not be
collected until an impact fees a§reement has been initiated between
the City and MUD. These fees are being collected on all plats which
did not have final plat approval prior to June 15, 1990. I believe
this issue was resolved by your September 20 correspondence, also.
6. (Your 5) The City will allow electric distribution line poles along
Heartz to be used for suspending street ii§bring, subject to certain
conditions.
7. (Your 6) The mutual drainage easement may be used to provide storm
drainage discharge points for Heartz Road provided grades, geometries
and other City requirements are followed.
8. (Your 7) Our normal 12 month work guarantee on the developer
improvements will be required here, as is the case generally.
Depending upon comments generated in our engineering review, the City
would typically require only those construction elements outlined in
your number 7 paragraph.
Regarding your August 31 correspondence, the final plat was approved
based, in part, on engineering drawings for streets showing the slope
conditions you requested.
I believe this addresses all the concerns outlined in your earlier
correspondence to the City, as well as the issues discussed by telephone.

The above referenced subdivision fronts Sandy Lake Road for the
length of 678.32 feet. Approximate cost of a four lane divided
road in a six lane R.O.W. for this project is:
678.32 F.F. x $170.40 (Per F.F.) = $115,585.73
100% Due prior to final acceptance of the subdivision
infrastructure.
Construction Permit Fee
$730,725 project cost x 2% = $14,614.50
100% Due at time of pre-construction conference.
