I have reviewed Mr. Allen's letter to you, dated April 27, 1990, and make
the following comments:
1. although not shown on the approved preliminary platting, a
subdivision in two phases is allowed.
2. the letter does not clearly state where the 8" sanitary sewer is to
be located, nor the size or location of the drainage facilities.
3. the drainage ease~ent was not enclosed.
4. the specific written confirmation regarding point #1 appears O.K.
provided we are not land-locking adjacent properties; point #2 needs
to be addressed by Public Works; point #3 seems O.K. if we have
latitude on locating curb cuts, median breaks, etc., and the
engineering/construction plans for Heartz Road accurately reflect
past agreements made by the City.
6. I'm not sure of the urgency of this request. Is Mike trying to beat
impact fees, is the construction of Heartz Road foremost in his mind,
does he need it for his development, or what?
I'd be happy to expand on any of my comments at your convenience, and
would close by quoting the Subdivision Ordinance: '...approval of a
preliminary plat...does not constitute official acceptance of the proposed
subdivision by the City."
