RE: Sewer line issue on 40.655 acres on the north side of Thweatt Road west of State Road
in Coppell, Texas
Dear Sirs:
This letter is written as a follow-up to a fax received from Stratford Group regarding locations
of utility lines on the above referenced 40.655 acre tract of land. Based on the faxed survey,
it appears as though the existing sewer line is outside the existing sewer easement. According
to our map there is no other water or sewer line that crosses this property. To determine if
there are any other utilities such as gas, electric, etc. that cross this property you should contact
those utility companies directly.
There are several options available to rectify the problem of the sewer line being outside the
sewer easement. One would be to dedicate a new easement and abandon the existing easement
by virtue of a separate easement. This would require City Council action. The earliest that
could be accomplished would be September 12th, assuming that all required legal descriptions
for the existing and proposed easements are provided no later than August 29, 1995. If that
date is not met, then Council action would slide forward in two week increments.
My recommendation is that at the time of platting you show the existing easement to be abandon
by the plat and show the location of the new easement on the face of the plat. This is a
procedure allowed in the City of Coppell. There is not a lot to be gained by the abandonment
of the existing easement at this time because prior to issuance of a building permit the property
has to be platted.
