Subject: Alley pavement resurfacing incident at 725 Alendale Drive, fall 2010
Upon leaving for work midmorning during one of the days that our alley way was
under repair, I got blocked in my driveway by the Backhoe Tractor entering from
the east end of the alley. As the tractor approached my driveway he reversed
into the driveway of Bill & Brenda so that I could proceed east out of the alley to
work. At the time I thought nothing of his actions and merely nodded thanks.
However, I believe this reversal caused his backhoe device in the rear of the
tractor to clip the gutter.
I remember the incident well, because it was a very nice fall morning. Also, I
noted as I drove away a few piles of surface debris scattered in the alley where
the repaved area was roped off with tape. When I returned from work about 4
pm I saw the same backhoe one block off Sandy Lake Rd. As I proceeded home
through the alley I could see that all the debris from the area were gone, although
the taped off (blocked) area remain that way for a couple more days.
I certainly did not see the damages to the gutters immediately or I would have
tried to contact my neighbors although I knew them to be out of town. It may
seem late to bring all this up but I never had any reason to suspect anything was
wrong or damaged until they got back home and we were talking in the driveway
directly under the damaged area.

We received a claim today for damages caused by a back hoe at 728 Woodmoor Dr. The damage was done from work being done
in the alley. The neighbor 727 Alendale says that when the back hoe moved out of the way to let the neighbor get out of the
driveway the gutter was damaged. The incident occurred in the fall of 2010. Please see the attached claim.
