Rhonda and Keith,
In response to your inquiries concerning the a homeowner who has been approached by
Jason Rose to purchase the common lot in Lost Creek and Keith's understanding that a
homeowner lodged a complaint that she is being charged for the water to irrigate this
common area, I contacted Mr. Rose.
I explained that all subdivisions which have any common areas are required by the
Subdivision Ordinance to establish HOA's for the maintenance of the common areas. I also
mentioned that this is specifically noted on the PD Site Plan approved by Council for Lost
Creek and is platted as such. He mentioned that the area was so small that he did not feel
HOA dues were necessary, etc.
I requested a copy of his HOA documents for Lost Creek for our City Attorney's review. I
also suggested that his HOA documents for Willow Park also be submitted a.s.a.p.

We're dealing with an issue regarding irrigation of one of the common lots...the person who called says
there is no HOA and Jason is trying to sell the common lot to someone for $5,000.
