ST0301A-CS110203 (8/15/2011) Keith Marvin - Re: Bethel: The Reserve-status Feb 2Page 1 From: Keith Marvin To:Chapman, Tery; Dumke, Dean; Murphy, Marty Date: 2/3/2011 12:57 PM Subject: Re: Bethel: The Reserve-status Feb 2 Dean, I think I understand all the issues. Let me know when you guys have made a decision on the proposed solution. Keith Keith Marvin, P.E. Project Engineer (972) 304-3681 >>> "Dean Dumke" <deand@JRJPaving.com> 2/3/2011 9:40 AM >>> Keith, The problem that Joe is not grasping is his contractor has already started his work. The Column has been removed, the light that was there is gone and he has built another structure in this place. As for restoring what was there, if given the okay from Marty and Tery, the conduit and wiring will be connected and brought to the median area, and checked to see if power is to this area, that is all. Clay does not t know what was there before, he did not even know there was not any power to the median until recently, which is the first thing you would think he would have checked. There was power to the median before, and given Marty's or Tery's approval, will be installed, but to a location in the center of the Penfolds median, not to a light, it has been removed by Joe's contractor, or to Joe's contractors stuff. Any further correspondence or meetings related to this matter must include myself, Marty, and Tery since Joe is including an attorney in his correspondence. Ultimately, it is Marty and Tery's decision if this is to find any resolve. Marty & Tery, Joe has returned the $500 check with a letter attached. The letter and the check are in the top right had drawer of my desk. I have not read or scanned the letter into JRJ's system, due to trying to work with Keith on this and try to find some resolve. Thank you, Dean Dumke (8/15/2011) Keith Marvin - Re: Bethel: The Reserve-status Feb 2Page 2 Sr Project Manager From: Joseph M. I spoke to Clay and he is clear in the belief that if all is replaced or reconnected as was, there should be no issue with his gear and/or installments. I'll await his feedback and hopefully we are closer to a resolution. I think we are close to working this out. I agree that this all would have worked better had you and JRJ agreed in writing what you were asking them to do up front. It would have saved us all some heartache. I believe that all involved have worked in good faith to provide a quality job. I think there was just a misunderstanding of what was agreed on. I have attached the written proposal from Mel's Electric that I received from JRJ. I hope this answers your request for a written document. Keith Marvin, P.E. Project Engineer (972) 304-3681 >>> "Joseph M. (8/15/2011) Keith Marvin - Re: Bethel: The Reserve-status Feb 2Page 3 I am amenable to paying the delta on the upgraded conduit...total of $725, less $500 check, netting to $225 from us. It would have been nice to know upfront this cost and, as previously stated, the 4 inch is far more than what is needed to support additional capacity. So be it! As for electrical restoration, Dean has mentioned the initial install was non-compliant, hence part of the reason it was dug up. We insist all electrical be restored to a functional state as was the case prior to construction. You also have an e-mail thread that captured Clays observations which are essential to ensure our entry project is functional when JRJ leaves. The aforementioned math does not allude to this activity and I am reasonably certain this is not a "no charge event" from JRJs sub contractor. Can you please address this major concern in writing? I should be available to speak around 3:30 if you'd like but at this juncture we need to see in writing the course of action. Thanks again for attention to this. I have forward your email to Keith, Marty, and Tery.  Dean   From: Joseph M. Altadonna [mailto:joemaltadonna@yahoo.com] Sent: Thursday, February 03, 2011 3:46 PM To: Dean Dumke Subject: update   Hey Dean Keith shared the quote from your electric sub-contractor and in principal I agreed to incur the difference in "check credit" and the upgraded conduit (approx $225). What isn't clear to me is if the electrical work that is proposed will replace what was actually there prior. I sent the bid over to Clays organization to see if this work does what is needed to get whole. I get the impression is does not. Again, we seek no "free electrical upgrades" and I will justify the expense for the upgraded conduit. I just need to know that what was there is replaced as before. If that bid covers it, then we are getting closer to putting this all behind us. thanks, we patiently await some progress on the matter.
