Box 478 Coppell, Texas 75019 Re · Belt Line Road Improvements from West Overflow Swale rd to the Dear Russell: I am enclosing the City Council Agenda Request Form and supporting documentation necessary for the Council's consideration of Dallas County's request for a letter from the City of Coppell stating that the City will not assess the St. Louis Southwestern Railway Co. for the subject road improvements. I spoke to Mr. Bud Beene of Dallas County Public Works this morning concerning this issue to insure that we adequately cover their concerns with the City Council. In that discussion we determined that the City should address their letter to Mr. J. W. Bryan, P.E., Director of Public Works, Dallas County. since the County is negotiating directly with the Railroad's management to acquire the Right-Of-Entry necessary to build the project, we felt that it would not be appropriate to inject the City into the situation. As mentioned in our meeting with Dallas County o~ Monday, the Railroad has the made the agreement with the County --contingent on the County paying any assessments levied by the City against Railroad property for the proposed road improvements, so it makes more sense to have the city of Coppell deal only with the County, allowing them to execute the pending agreement almost immediately. Box 478 Coppell, TX 75019 Re: Belt Line Road Improvements from MacArthur Boulevard to the West Overflow Swale - Coppell, TX Dear Russell: In response to your Rapid Letter dated 10/3/88 concerning the pending agreement between Dallas County and the St. Louis and Southwestern Railway Company, we contacted Mr. Bud Beene at the Dallas County Public Works Department. Mr. Beene informed me that after lengthy difficult negotiations, Dallas County has reached a proposed agreement with the Railroad for a right-of-way entry which is absolutely necessary for construction of Belt Line Road. This agreement is contingent on the City of Coppell writing a letter to the St. Louis and Southwestern Railway Company promising that tile City will not attempt to levy an assessment against the Railroad for the Belt Line Road improvements. We strongly recommend that the City of Coppell furnish the letter now so that the agreement can be executed and construction on the project can proceed as soon as possible. The City has previously entered into an agreement with Terra Land Development who volunteered an assessment of their Riverchase property fronting the north right-of-way of the Railroad, which should remove the Railroad from any consideration for assessments for Belt Line in in any case. The plans from MacArthur Blvd. to the West Overflow Swale will be completed next week pending further comments from the City, County, or M.U.D. It is our understanding that the County's intention is to combine these plans with the plans for the Carrollton segment of Belt Line Road and advertise them for bidding in November.
