Gentlemen,
It appears that we have a couple of problems on Bethel Road.
The first is the illuminated street signs. When they were erected I noticed that Bethel Road shows as Bethel DR on all four
Bethel signs. This is not correct and needs to be fixed. The attached email was provided to Lance and Mark with Mel's
Electric on February 6, 2008 showing the sign layouts. I understand that a subsequent submittal was received and that this
error was not caught on that submittal NCTCOG section 105.3 Shop Drawings spells out the fact that the contractor is
responsible for errors or omissions in the submitted data regardless of any review by the engineer.
The second issue is with damage to a fire hydrant installed under this contract. Randy has apparently told Rick that Tiseo
will need to be paid to fix the damage caused by a passing truck. I want to point out that under NCTCOG section 107.19
the contractor is responsible for protection of work. 107.19.1 states "During performance, and up to the date of final
acceptance, the contractor shall be under the absolute obligation to protect the finished work against any damage, loss, or
injury.
If you feel there is any ambiguity in these sections, and wish to discuss it further, please feel free to schedule a time to
come in and discuss it.
