Heartz Road-Perkins Right-of-Way
Temporary Construction Easement and Slope Easement
Dear Mr. Ratliff:
The Perkins heirs have informed me that all of the instruments to complete the
dedication of the Heartz Road right-of-way have been signed, but they require a letter
from the city concerning replacement of the fence which will have to be relocated
when construction commences.
I contacted Jerry Parche' and he agreed that this relocation of a fence would
be part of their contractor's responsibility and expense. I have therefore prepared a
letter to Ms. Shields, representing the Perkins heirs, a copy of which is enclosed.
Because the easements are dedicated to the c~_ty, my letter to Ms. Shields
represents the city's agreement with the Perkins heirs that the fence will be relocated
and replaced at the new location in equal or better condition than the original fence.
This letter to you is to assure the city that I have reviewed this matter with Mr.
Parche' and that relocation of the fence will be a part of ABQ's agreement with its
contractor when they construct the roadway.

contact me, and I hope to have all of the instruments signed and in my possession by
the end of this week.
