Temporary Construction Easement and Slope ~asement
Dear Ms. Shield:
You have informed me that ~l necessary parties have si~ed the instruments to
eomplete dedication of the ~eartz Road right-of-way, but you would like to have a
letter from the city concerning the fence which presently exists on the property.
It is apparent that the city wi~ have to move a portion of the existing fence
from its present location. You can be ~sured that any portion of the fence which is
relocated will be replaced at the new location and will be equal or better condition
than the originaI fence.
You have indicated that ~antors have no objection to the fence being replaced
permanently at the east right-of-way line of the slope easement, but will leave it up to
the discretion of the city ~ to whether the permanent location wiIl be this line or the
east street right-of-way line. ~owever, if the fence is located at the east right-of-
way line of the slope easement ~ou want it ~derstood that fee title to the property
under the slope easement remains with grantors subject only to the slope easement.
We have assured you that this is correct ~th in iaw ~d by agreement with the city.
