We briefly discussed this a few weeks ago. The purchase agreement we entered into in August 2008 with PAC Trust to
reconstruct Southwestern Blvd had a maximum price of $1,850,000. The Actual city cost after bids were opened was
$1,427,787.28. We have asked the contractor through Pac Trust to add some additional work that will cost approximately
$80,000. Since the contractor is working for Pac Trust, we are proposing to amend the original agreement to include this
work.
I have taken a stab at an amendment. Please provide some feedback, or a new document, as you see fit. I will also need
to forward it to Pac Trust for review.
The original agreement is attached for your reference.

Amendment To
Purchase Agreement
This AMENDMENT to the PURCHASE AGREEMENT is made by and
between the City of Coppell, Texas (the “City”), and PW Commerce Center, LP, a
Texas Limited Partnership (the “Company”), acting by and through their respective
authorized officers.
RECITALS
WHEREAS, City and Company entered into a PURCHASE AGREEMENT
on or about August 28, 2008 to construct the “Project”;
WHEREAS, Company is diligently working towards completion of the
PROJECT, the scope of which is detailed in the original agreement;
WHEREAS, City desires to expand the scope of the project to include a new
aerial sewer line crossing, and removal and replacement of additional concrete
pavement, both of which have been provided to Company for review and pricing
purposes;
WHEREAS, the Company agrees to expand the original scope to include this
additional work.
NOW THEREFORE, be it resolved that the original PURCHASE
AGREEMENT is hereby amended to include the additional work listed herein, and
shown in the attached exhibits. City hereby agrees to increase the purchase price by
$XX,XXX to compensate Company for all costs associated with this additional work.
