I was told the crossing agreement we have is between FWWR and the City of Coppell; the agreement clearly stipulates flagging requirements, cost per hour, and the 8-hour minimum. In our contract with them, the city has stipulated that they are responsible for all charges from the railroad above our cost for the signal and crossing itself. I have forwarded the invoices to JRJ for processing, and they sent me the below response. I think they raise some valid concerns. Before I respond to them, what are your thoughts on their issues? And as I suspected they are trying to charge me a minimum of eight hours every day they show up. They only worked one day that was a full eight hours the rest were four hours or less. I am also being charged for one day when we had to cancel due to weather. All projects that we have done previously requiring flaggers required we pay a minimum of four hours, not eight. I do not have a contract with FWWR where I have committed to pay for an eight hour minimum or we would have scheduled their assistance differently. I am not going to pay these ridiculous charges as invoiced. I will pay for the one day they work a full eight hours and the remaining days will be paid at the minimum four hours excluding the one cancellation day where they were given ample notice due to inclement weather. The invoices for this work were forwarded to JRJ for payment. Under the terms of JRJ's contract with the City of Coppell, JRJ is responsible for coordination with the railroad for all necessary shutdowns, and to provide flagmen when necessary.
