Dear Hr. Gtnn:
This letter ts written to you In your official capactty as Ctty Engineer
and Floodplain Administrator for the City of Coppo11, and docummts_ e
meeting tn our office on Apr11 27, 1966, to discuss.specifically the portlofl
of Cottonwood Creek upstream of Denton Tap Road, 'kn°t?~ 816o as. Par~s ~of
Coppe11 Jotnt Venture Il. Those tn attendance ~ere Raryetta ~unnlngnm
and Btll Kuno of this offtce, Hr.'Dan i)omJy and yourself.
The purpose of the meettng was to dtscuss that provision of the Ctty's
Floodplain Ordinance which allows exception to the more stringent destgn
crtterta tn cases ~here a "prior conditional approval from FERR has been
obtained prior to enactment of the ordinance."
As explained tn our prevtous letters dated 14arch 30 and April 11, 1988,
a thorou h search of ftles tn our offtce and by the engineering staff

for that portton' of Cottonwood Creek had been sulxnttted tO F~I~ or cna~
any Conditional approval for a proposed project had been tssued by FEIaA.
I~wover, our research dtd document and vertfy that a submittal was made
on June 20 1982, by Carter & Ourgess of more refined technical data which
showed the~EHA study and maps to be tn error for that portton of Cottmmood
Creek wtth whtch Hr. Dowdy ts concerned. That submittal resultnd In our
data and our tssuance
evaluat'ton and approval of the submitted technical
of a preliminary and final map revtston to incorporate the Carter & Burgess
data.
ts the role of the City of Coppe11 to evaluate any request for exception
~om the more stringent destgn crJterta ~f 1ts ordinance under the basis
established for such exception; t.e., the obtaining of a conditional

portion of Cottonwood Creek constitutes a "prior Conditional approval
from F£HA', then the City could Justifiably allow the exception to the
property owner, i must emphasize, however, that this ts. an Interpretative
decision to the ordinance whtch must ultimately be made by the Ctty of
Coppe11 rather than the Federal Emergency Management Agency.
Should you need further assistance tn this matter or tn other concerns
of the City's floodplain management program, please.contact Hrs. Cunntngham
