Dear Jay:
As I reported to you in our telephone conversation of May 30,
1989, on E'riday May 26, 1989, I observed a fully loaded scrapper
leaving your property in Coppell. The scrapper then deposited
the hauled material in the Denton Tap Road Right-of-way. At my
request, Mr. Skip Klement of b. H. Lacy, project manager on the
referenced project, inquired about this activity with other b. H.
Lacy personnel.
Mr. Klement reported to me yesterday that L. H. Lacy removed
three scrapper loads of material from your property and used this
material to make subgrade in Denton Tap Road. Mr. Klement
acknowledged that it was inappropriate for L.H. Lacy to have
removed this material without prior authorization. He said it
was done due to an immediate need for fill material in Denton Tap
Road. He said that L. H. Lacy intends on replacing the material
removed from the ABQ site.
As I have previously advised you, L. H. Lacy has notified us in
their letter of May 16, 1989, that they anticipate a shortage of
dirt for backfilling curbs in Parkway Boulevard and the High
School Access Road. The acknowledged removal of material from
the site by b. H. Lacy jeoparidizes the validity of any backfill
deficiency claims.

of this letter, h. H. Lacy is notified of the following:
b. H. Lacy should provide me written documentation of
the date that they replaced the dirt that. they
previously excavated and removed and the location of
the replaced dirt on the site.
Pursuant to your request, L. H. Lacy is notified that
no material shall be removed from the ABQ Development
Corporation site without prior authorization for any
reason. This includes the proposed RiGht-of-Ways of
Parkway Boulevard and the High School Access Road.
