discuss the landscape elements within the medians south of the
intersection. Our discussion centered on the restoration of these
elements on the areas removed due to construction.
Mr. Harrell, while admitting that the materials were removed at
the request of his project engineer, feels it is the owner or
owner's agents duty to replace the elements. He did submit a
plan which placed some trees, grass and an automatic irrigation
system within the construction zone. The argument he raises is
this was his duty but to extend beyond that zone should fall to
those who removed the materials. No direct benefit can be derived
from extending beyond the zone in Mr. Harrell's opinion, for his
project which is north of the intersection. The only benefit
would be the beautification of an area of his competition by his
firm which is ridiculous in his thinking.
In evaluating the situation, it is my recommendation and conclusion
that to further seek the landscaping removed should fall to the
party to whom the greatest benefit will fall, Valley Ranch
Association.
The persons who manage the Valley Ranch have previously stated
they may well return the area to a state similar to that existing
prior to construction. The persons who managed the area prior
to construction were directly involved in the removal of the
elements and relocated them to other areas of their project, no
longer recalling the location while allowing others to be stolen
because they remained along the roadside after removal.
The design of the intersection as it exists now will not allow
a return to the scale of landscaping once located here. Therefore,
I recommend the installation of 2 Cedar Elms within the median
at the bridge and the acceptance of the elements as is. Further
pursuit of this issue will not lead to any additional landscaping
according to Mr. Harrell.

Richard, this is to request you to contact Bobby Harrell with Terra
Development and discuss with him what you feel is necessary in
order to suffice the landscaping requirements in both medians south
of the intersection referenced above. By July 11, 1988, I will
expect some type of resolution, if possible, in order to move forward
from this point. Steve Morton has prepared a letter, which you
were carbon copied on, to Mr. Harrell identifying the punch list
items that are deficient at the intersection as well as the MacArthur
Blvd. road construction up to the Woodridge Subdivision, Section
4.
If you have any questions, I will be calling in Wednesday, June
29th at approximately noon, at which time you can discuss those
matters with me. Thank you.

Dear Mr. Harrell:
As per your request for a letter explaining what it will take to
sell this project to the City, please find the following list of
difficient items needing to be resolved.
On June 23, 1988, Public Works, Water Utilities, Streets and Parks
departments performed a verification of punch list items submitted
to Nathan Maier on September 24, 1987, to be completed for final
acceptance.
The following are the remaining items that as of this date have
not been accomplished.
Water Utilities Department
2) Jet rod and vacuum sewer main free of mud and standing water.
4) 25 + 34.50 - Manhole ring needs to be reset and manhole cleaned
OUt.
6) 20 + 00 24" Valve needs extension
8) 25 + 00 24" Valve covered up.
11) 6 + 50 Line "A" not able to locate manhole.
Fire Department
Ail 4 punch list items have been satisfactorily addressed.
Sign/Signals Department
4)
Due to poor application of railroad symbols and stop bar, they
have worn off.
The signal pole that was destroyed by a truck has been handled
by the truck's insurance and will be installed in July. This item
should not hold up acceptance.
The other 3 items have been satisfactorily addressed.
Street Department
3) Many of the curbs have chips missing.

The patches are not holding and will need to be redone.
The other 5 items have been satisfactorily addressed.
Parks Department
The landscaping in the 2 medians, south of Beltline/MacArthur
intersection to the city limit line at the bridge still has
not been resolved.
Additional Items (Walk-thru 6/23/88)
1) Sidewalk cracked in 7 locations. ~
2) 4' random crack east side under 2nd power line.
3) Mud ball holes south of Riverchase.
4) Spalling 2nd panel south of 2nd entrance from the north end.
5) Pave stones missing around sanitary sewer manhole southwest
corner, 1st entrance.

After reviewing your memo of June 15, 1988 concerning the landscape at
the above mentioned intersection, one question comes to mind. Have all
three parties met to resolve the issue? If this is not the case I would
suggest that you schedule a meeting between Terra, Community Management
Associates and the City of Coppell to determine the minimum requirements
that the City would have and to reach a mutual agreement to bring this
issue to a close.
If I can be of assistance in this effort please advise.

I have obtained and reviewed plans and photographs of the landscape
plantings that were located in the median areas of S. MacArthur,
therefore, city property prior to construction of the intersection
in place now.
These materials were removed to accomodate construction of the
intersection by others on the invitation of the intersection's
engineer. At no time was the City informed that this was taking
place and of the necessity to have it take place.
The plans and photographs show an extensive amount of landscaping
that was in place and removed. Some of the materials removed
were relocated according to Community Management Associates within
the Valley Ranch area. The irrigation system, to staff's
understanding, was removed by the irrigation company.
I have prepared a brief estimate of the materials removed with
today's cost of replacement for your information. The estimate
is as follows:

These items totaled to $7571.16 in today's figures as listed.
The developer of the intersection has installed other amenities
to replace those removed at this time. The developer is possibly
going to add 2-3 more cedar elms on the bridge median to satisfy
our concerns in his mind. The amenities added are not of the
same type removed or to the extent of those removed. If a
consistent design or theme to the landscaping is to remain, the
extent removed must now be replaced as was prior to construction.
If this does not occur, the gateway desired from Valley Ranch
will be of little significance and of lesser quality than that
formerly in place.
The landscaping and irrigation in place was never inspected or
approved by the Parks department. It was and continues to be
maintained by the Valley Ranch Association through Community
Management Associates. If either the developer or this group
can agree to jointly replace what existed on an equal basis, this
matter could be quickly resolved. If not, the payment or acceptance
of the intersection will be delayed as this item remains on the
punch list unless other arrangements are made.
