These are easements across the park property that we purchased along
MacAarthur and across the property on Sandy Lake that has our 500,000 gal
storage tank on it.
I've provided an overall exhibit to show where the easements are. I'm unsure
if you or the Mayor is supposed to sign the documents. It it's the Mayor we can
just insert his name & title. This easement will contain the new Irving Water Line
of which we are paying 1.7 million for.

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF DALLAS §
THAT We ,City_ of Coppell, Texas, a political subdivision of the State of Texas
hereinai~er referred to as Grantor(s), whether one or more, for and in consideration of the sum of
One Dollar ($1.00) cash to Grantor(s) in hand paid by the City of Irving, the receipt of which is
hereby acknowledged, and the further consideration of the benefits to be derived by Grantors from
the water main through the premises hereinaRer described, have this day Granted and Conveyed,
and by these presents do Grant and Convey, unto the City of Irving, a municipal corporation
situated in Dallas County, Texas, an exclusive easement to construct, reconstruct and perpetually
maintain water main or mains in, upon and across the following described land, to-wit:
All that certain tract, piece or parcel of land, lying and being situated in the
County of Dallas, State of Texas, described in EXHIBIT "A", "B", AND "C'
attached hereto and made a part hereof for all purposes, to which reference is here
made for a more particular description of said property;
TO HAVE AND TO HOLD the same perpetually to the City of Irving, its successors
and assigns, together with the right and privilege at any and all times to enter said premises, or any
part thereof, for the purpose of constructing and maintaining said water main, and making
connections therewith; all upon the condition that the City of Irving will at all times, aRer doing
any work in connection with the construction or repair of said water main, restore said premises to
the condition in which same were found before such work was undertaken. Said exclusive
easement shall not be used by any entity either in whole or part without the written express
permission of the Director of Public Works, City of Irving. City shall have right to enter premises
at any time, in addition to the purposes stated above for the purposes of clearing said easement of
any improvements, trees, vegetation, or other obstructions or possible obstructions as deemed
necessary by Director of Public Works, City of Irving to protect the integrity of the water main. In
the event removal becomes necessary of unauthorized improvements placed on the easement by
Grantor, Grantor shall bear reasonable costs for such removal.
Reserving, however, to grantor the right to use said easement for purposes of landscaping,
paved parking lots, recreational uses, public right-of-ways or other uses if approved in writing by
the Director of Public Works, City of Irving.
In the event that the property encumbered by this Exclusive Water Main Easement is
dedicated and accepted as public fight-of-way either in whole or in part, that portion of the
exclusive easement shall become null and void and no longer in effect. In no way however shall the
dedication and acceptance of public right-of-way over a portion of this easement nullify or in any
way affect the enforcement of the remainder of the easement not dedicated and accepted as public
right-of-way.
Grantor also hereby grants temporary construction easement as described in Exhibit "A',
"B", and "C" for the purposes of constructing the water main. Said temporary easement shall
automatic. ally terminate aRer twenty-four (24) months or the completion of the project, whichever
occurs first. Said temporary easement shall be used, should the contractor find it necessary, for the
storage of men/and or equipment during construction.
