Box 540787 Dallas, TX 75354-0787 Re: Belt Line Road (South) Coppell, TX Dear Mr. Albert: Per your attached letter and the input offered at the January 3, 1989 meeting, we offer the following comments. The pavement at approximately centerline stations 25+90, 30+35, and 35+00 are cracked. Full pavement depth cracks were observed during construction and brought to your field superintendent's attention by our field representative. The Owner will not pay for a defective final product. The Owner nor the Engineer will advise Ed Bell Construction Co. on the means and methods necessary to correct such work. It is Ed Bell Construction Co.'s responsibility to select the appropriate means and methods to analyze the situation. Comment was made at the January 3, 1989 meeting that in these same locations the interior lane, Northbound, was now also cracking and this supported Ed Bell Construction Co.'s conclusions that the original two (2) Northbound lanes cracked due to the high PI subgrade material. A follow-up investigation by our field representative after that meeting failed to reveal any such cracks existing in that inside lane at the locations mentioned herein. We will be happy to meet on-site with your representative(s) for confirmation. In summary, we cannot obligate the Owner to any additional responsibilities over and above what the Contract provides. Beltline Road City of Coppell Gentlemen: In response to our meeting January 3, 1989, we do not feel that the cracks that have appeared at right of centerline stations 25+90, 30+35 and 35+00 are a result of inferior materials or workmanship, but are a result of the high P.I. and expansive clays that are found in that area. We will, however, under the terms of Division I, Section 01010, Paragraph 1.13C of the specifications, remove the concrete pavement, cement treated subgrade, test and remove the clay backfill, remove the reinforced concrete pipe, and test and remove the cement treated base material that is under the pipe. Should these tests prove to be generally within the parameters of the specifications, we would expect the owner to pay for this re-examination. Prior to making any removals, we request that you furnish us with a detailed sequence of steps for us to follow in order to properly analyze this situation.
