Dear Mr. C~=pbel!:
Please allow this letter to address our teleconference of this
date. Presently, it is understood that there is an outstanding
punch list to be completed on the subject project. The item of
concern was the issue surrounding the cracked driveway and resolu-
tion of this issue prior to final payment on the project. Attached
you will find a report from our insurance company a~praising the
repair at approximately $6,655.50. The problem Ks that the
insurance company believes the claim to be falsely asserted. There-
fore, in order to final this project Kenko will secure a bond in
the sum stated by the insurance company to assure the City of
Kenko's resolution of this issue. The issue of liquidated damages
was discussed and it is understood that the notice of substantial
completion has been filed and therefore this issue is probably
moot. However, should there be a concern on this issue please ad-
vise immediately.
I hope that the bond will satisfy your concerns, please advise
accordingly.
