Box 478 Coppell, Texas 75019 Dear Mr. Griffin, Subject: Window damage, 208 E. Bethel Rd. As we discussed at our meeting on November 8, we believe that several windows on the front of our house have been damaged as a result of the sewer construction project earlier this year. We have had several windows replaced during the 5 years we have lived here. They were all replaced under warranty by the original vendor, HR Windows. Since the five-year warranty was nearing expiration, my wife and I did a very thorough inspection for damaged windows in late March. No problems were found at that time. On April 15th a sewer project pit was dug in the street directly in front of our house. That pit remained until mid August when Kenko, Inc. had great difficulty removing one of the three boxes from the pit. They began the removal on a Saturday and returned the following Monday to work nine more hours before releasing the wedged-in box. During that time two pieces of heavy construction equipment were banging, pulling, pushing and jerking to release the box. The house was constantly jarred and shaken and large pictures on the walls were knocked askew. The following week my wife noticed that a living room window was cracked. We then inspected all of the windows and discovered several with broken seals, all on the front of the house. Following our discussions with Garreth Campbell of your staff, we were contacted by CNA Insurance on behalf of Kenko, Inc. Last week we were notified verbally by CNA that they were refusing our claim, having determined that their client was not at fault. We have not yet received notification in writing. We realize that this window damage could occur as a result of other causes, but when the facts are considered, we feel certain that the construction work was the significant contributing factor. As you requested we had a window professional evaluate the damage. He found seven windows with broken seals and one cracked window, which will cost approximately $700 to replace. It was his opinion that the broken seals could have been caused by the conditions we described and that the cracked window definitely was not a stress fracture caused by settling.
