Dear Mr. Pratt:
Included with this letter please find a copy of the filed easement for your property. I apologize for the
delay in getting this easement filed and in getting the filed copy back to you. There apparently was a
breakdown in communication between myself and my former secretary in that the easement you provided
to the City was never filed with the County but only filed in our central files. After your previous letter,
our research found the easement and it was filed with the County on November 4th, 1993. I failed to
mention that there was a time lag of approximately 4 to 6 weeks for the County to mail back the filed
easement. However at your request, I did send one of my employees to Dallas County to pick up a copy
of the filed easement for your records.
During our conversation, it was my understanding that the main concern with the construction taking
place on and adjacent to your property was that the contractor restore it back to the condition it was prior
to construction. As stated in our conversation, the contractor will restore your property to as good as
or better condition. With this letter, I am also including a copy of the Contract Bid Documents which
states under Section 1.25 Easements and Rights-of-Way the following: "Contractor shall repair, replace
or restore all grounds, fields, terraces, etc. to their original or better condition, and to the satisfaetlon
of the property owner and tenant involved".
The City appreciates your cooperation in providing the easement and in working with our contractor.
Please be assured that the contractor is under contractual obligations to return the property to as good as
or better condition and to your satisfaction. If the contractor fails to repair your property to your
satisfaction please let either myself or Garreth Campbell, Construction Inspector, know as soon as
possible.
