Discussion and consideration of approval of an ordinance abandoning Riverchase
Drive west of MacArthur Blvd. and authorizing the Mayor to sign.

As Council is aware, there is ongoing negotiation with representatives from Texas CED
Constmction Partners Limited concerning the resolution of a law suit. One of the items to
facilitate the resolution is the abandonment of Riverchase Drive from MacArthur Blvd. west to
its termination. The City of Coppell Engineering Department has reviewed this request and
offers no objections.
The property on the east side of the existing TU power lines is currently commercially zoned
and will more than likely be developed as such. The TU power lines offer a natural buffer from
the commercial development to the property on the west side of the power lines which is
currently zoned TH 1. The TH 1 property has a street stubbed out south from Pelican and there
could also be an opportunity to access it from Mockingbird Lane. This section of Riverchase
Drive is not currently shown on the Thoroughfare Plan to be a collector street.
Taking in account the above considerations, staff recommends approval of the abandonment of
Riverchase Drive from MacArthur west to its termination. Staff will be available to answer any
questions at the Council meeting.

AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
ABANDONING A PORTION OF RIVERCHASE DRIVE WEST OF
MACARTHUR BOULEVARD, BEING FURTHER DESCRIBED IN EXHIBIT
"A", AND DEPICTED IN EXHIBIT"B" ATI'ACHED HERETO; PROVIDING
THAT SUCH .ABANDONMENT SHALL BE THE INTEREST WHICH THE
CITY MAY LEGALLY AND LAWFULLY ABANDON; PROVIDING THAT
SAID ORDINANCE SHALL CONSTITUTE A QUITCLAIM DEED THAT
MAY BE RECORDED .WITH THE COUNTY CLIr. RK OF DALLAS
COUNTY, TEXAS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Coppell has determined that the portion
of Riverchase Drive west of MacArthur Boulevard being further described in Exhibit "A"
and dePicted .in Exhibit "B", is nO.longer needed for City services; and

of the City and the public therein should be abandoned; and
WHEREAS, the City Council of the City of Coppell has determined that thc City and
public have no need for such portion of Riverchase Drive west of MacArthur Boulevard,
and that the cost of keeping and maintaining such portion of Riverchase Drive west of
MacArthur is in excess of the fair 'market value of the City's interest in the portion of
Riverchase Drive west of MacArthur Boulevard being abandoned;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. ~ That the City Council of the City of Coppell, Texas has
determined that the portion of Riverchase Drive being further described in Exhibit "A" and
depicted in Exhibit "B", attached hereto and made a part hereof for all purposes, is no
longer needed or necessary for public purposes and should be abandoned in favor of thc
abutting property owner, Rivcrchasc Joint Venture.
SECTION 2. That the City of Coppell, Texas, hereby abandons all its right, title, and

interest in and to said portion of Riverchase Drive, and abandons, conveys, and relinquishes
all such public interest the City may have in and to said portion of Riverchase Drive to the
abutting property owners.
SECTION 3. That the City Council of the City of Coppell, Texas, has determined
that the cost of keeping and maintaining such portion of Riverchase Drive is in excess of the
fair market value of the City's interest in the portion of Riverchase Drive being abandoned.
SECTION 4. That the abandonment ordinance of the City's interest in said portion
of Riverchase Drive shall constitute a Quitclaim Deed in favor of the abutting property
owners, and a certified copy of the same may be filed in the Deed Records of Dallas
County, Texas, to indicate such abandonment.
'SECTION 5. That the abandonment provided for herein shall extend only to the
public right, title and interest which the City of Coppell, Texas, may have in and to said
portion of Riverchase Drive, and shall be construed to extend only to such interests that the
governing body of the City of Coppell, Texas, may legally and lawfully abandon.
SECTION 6. That this ordinance shall become effective from and after its passage
as the law and charter in such cases provide.
