We have reviewed this prqiect in accordance wilh Section 404 o[ the Clean Walcr Act
and Scclitm 10 of the Rivers and ll;u'bors Acl of 1899. Under Seclion 404, Ibc U.S. Army
Corl)S of Engineers regulales the discharge et' dredged and fill material into waters of
Untied Slates, including wcllamls. The Coq}s responsibility under Seclion 10 is Io rcgulale
any work in, or afl,cling, navigable waters or Ihe United Slales. Based on your descriplion
of Ihe i}rOl)osed work, and olher inlbrmation avaihtblc to us, we have determined bec;nme of
Ibc microlmmeling below Grapevine Creek in lieu of the open cul above, this project will not
