Dear Ms. Vick:
I have reviewed your plans for the construction of MacArthur Boulevard
and the installation of a 36-inch water line casing over the Continental
Pipe Line Company (CPL) operated Con-Dot Pipe Llne Company 6-1nch high
pressure petroleum products pipeline, Continental Pipe Line Company will
permit installation of the new roadway and water line over the pipeline
upon the developer, contractor, and the City of Coppell agreeing to the
following requirements:
Relocation and modifications to the pipeline are required prior to
the initiation of any construction near the pipeline. The proposed
relocation has been shown on the attached plans. The relocation is
necessary to remove the pipeline from conflict with the proposed
3-24-inch RCP storm culvert. The pipeline modifications will
include the installation of heavy-wall concrete-coated pipe to
withstand dynamic forces of the roadway and for structural pro-
tection during the installation of other utilities. The cost of these
modifications, estimated to be $26,000 as given in Exhibit I, will be
borne solely by the Developer. CPL will manage all work performed
on the pipeline.
Construction joints shall be placed in the concrete roadway to
facilitate access to the pipeline, The jointed breakout section shall
be placed parallel to the pipeline and shall provide a 20 foot wide
section for access, the center of which shall be the center line of
the pipelineo
The CPL line shall be exposed a ,minimum length of 10 feet during
bore construction of the 36-inch casing for the' water line.
Adequate shoring and bracing shall be maintained in accordance
with OSHA requirements.
The bore for the water line shall be initiated on the north side of
the railroad (opposite the CPL line)·
The outside diameter of the water line casing shall maintain a
minimum separation distance of 36-inches from the outside diameter
of the CPL line,

The CPL line shall be backfilled with a clean sand material to
provide uniform support between the casing and the CPL line.
Any utilities, other than the 36-inch water line casing, which cross
the CPL pipeline must pass underneath by a minimum of 12-inches.
Any utilities, including storm sewers which parallel the CPL line,
will maintain a minimum separation distance of 15 feet to the CPL
line.
An interference survey will be made between the CPL line and the
installed water line casing and, if required, necessary steps taken
to prevent the sacrifice of either line. Any required modifications
to the cathodic protection system will be at the expense of the
developer.
Continental Pipe Line Company shall be named as additional insured
without any qualifications or restrictions by the Contractor perform-
ing work near the CPL pipeline. A certified copy of the insurance
policy shall be received at the CPL office in Lake Charles with
Continental Pipe Line Company named as the certificate holder prior
to the commencement of work.
The contracting company shall indemnify and hold Continental Pipe
Line Company harmless from and against any and all claims for
injuries to person or persons or for damages to property arising
directly or indirectly from work to be performed by the contracting
company or its sub-contractors near CPL's pipeline.
The contracting company shall assume all responsibility for any and
all damages to the Continental Pipe Line Company pipeline arising
directly or indirectly from work to be performed by the, contracting
company or its subcontractors.
The City of Coppell shall indemnify and hold Continental Pipe Line
Company harmless from and against any and all claims for damage to
the water line and/or encasement arising directly or indirectly from
work being performed by Continental Pipe Line Company or its
Contractors on the CPL pipeline. This indemnification shall apply
to all future work.
Before proceeding with pipeline construction to accommodate the
proposed development, CPL will require that 100 percent of the
cash equivalent of the cost estimate given in Exhibit I be paid to
CPL prior to construction. The Developer .will be charged actual
costs for the construction, whether higher or lower than the esti-
mate. Actual costs will include all construction costs, overhead,
and lost revenue due to downtime.
CPL requires a minimum of 48 hours notice prior to any excavation,
construction, or movement of equipment over or near the pipeline so
that the line can be staked to minimize the possibility of accidental
damage. The Developer shall indemnify and hold CPL harmless from
and against any and ali claims for injuries to person or persons or
for damages to property arising directly or indirectly from work to
be performed by Developer or those under contract to Developer.
To initiate work on the pipeline modifications to accommodate the proposed
development, please have a copy of the letter executed by an officer of
the development Company, the Contractor, and the City of Coppell and
return to me along with deposit of funds for the required modifications.
