I received the Right of Way Easement regarding the proposed dedication of Freeport
Parkway. Based on review of the document by our attorney, Catellus would request that
the proposed right of way be conveyed by Dedication Deed in lieu of an easement.
Catellus would prefer to dedicate in fee which would simplify issues that my attorney
raised if conveyed by easement. Please give me a call to advise if this is an acceptable
means of conveyance by the city.
On a related matter, Catellus would request the city's consideration for the cost of
Freeport Parkway in establishing a "bank" to offset appropriate impact fees. In addition, I
am also assuming we will be able to include Wrangler Drive costs in this "bank" as well. I
would appreciate hearing fi.om you relative to both of these issues.
