Dear Mr. Doyle:
Attached please find a copy of second notification to L. H. Lacy
Co. regarding the above referenced claim. If, within a
reasonable time, the claimant does not receive satisfactory
results, he should then have his insurance company contact L. H.
Lacy Co.'s insurance company for resolution.
This appears to be a matter for the applicable insurance
companies to handle. Contractually, this does not involve the
City of Coppell or Ginn, Inc.
The only remedy the City may have would be to withhold payment in
accordance with the General Conditions of Agreement, Paragraph
5.08, although the Contractor has provided a performance and
payment bond to protect the Owner in the amount withheld.
