Trish,
I know Ken is going to want to sit down and talk through some of these issues, especially the ones that
have costs associated with them.
Right now the effort needs to be to resolve the wall issue so we can move forward with the project. I met
with the property owner, our city arborist, and the contractor this morning. According to my analysis, we
have a trapezoidal encroachment into this property of approximately 2 feet at the west end that narrows
to about 4" at 55 feet east of the beginning point. The other issue we have is damage to trees belonging
to the homeowner that fall within the encroachment.
The options as I have discussed them with the homeowner are as follows:
1. FNI prepares an easement document that we then use to acquire an easement from the owner
covering the current location of the wall. The costs associated with this option are the preparation of the
documents, the compensation for the easement, and the compensation for the damage to the trees. The
compensation at this point is unknown, however the property owner inquired about whether the wall could
be extended to create the screening wall that he had previously inquired about.
Can you have your structural engineer re-visit the issue of extending a solid wall on top of the retaining
wall using the footer already in place? The question at this point is how high can it be built on the existing
footer, and does it make sense to do it as cast in place concrete, or as a block wall.
2. Option two is remove all, or a portion of the footer that has been poured, and simply move the wall
over into our ROW. The costs associated with this option are the compensation for the damage to the
trees, and the cost of paying the contractor for the work they have done so far, and the value to remove
the work. We would then pay the contract unit price for the wall in the new location. Additional issues
associated with this option include delays to the project and potential conflict with an adjacent utility pole.
I have asked our arborist to bring someone in to work on the trees to minimize the future impact of the
tree damage. If you or your structural engineer have any other suggestions for ways to address this
issue, please let me know. In the mean time, please have your structural engineer look at the solid
screening wall issue. If he needs more information, please have him give me a call so we can discuss it.

Great, thanks for your definitive response! Dan and I will sit down and make sure our construction plans
reflect the bands properly and in the locations noted.
By the way, I tried to call Ken to set up a meeting with him about all the issues on Bethel, etc. I couldn't
get anywhere in the voicemail system. Is it best to work with Rhonda to set up a meeting or send Ken an

Okay, my only concern is that the banding at Coppell will be well beyond where the crosswalk is. I
thought we were using the banding to denote the crosswalks as well as an entry feature. I will certainly
defer aesthetics to planners but I just want to make sure we are all on the same page. I have not
consulted our landscape architect for his opinion on the matter. Are you interested in his input or do you
already know that this is exactly what you want?

I have clouded the locations we feel are appropriate with notes outlining the width. Gary and I feel like the
ones on Coppell Road should be as wide as the ones at the Bethel/Main Street intersection to denote
entry into the project.
