In the past, we have communicated with the homebuilder as well as the engineer about this
issue. Our communication with them has always been that they can not build over their lot line
without re-platting the property, which would need HOA approval and neighbor approval. And,
even if they did replat, they would not be able to build permanent structures over the existing
drainage easement. Our building inspections department is aware of this on-going issue. I have
not seen any plans for a pergola but if you send them over to us or come in, I can help you
decipher the plan.

I believe they have asked the question in the past for a fence and gazebo structure that were
going to encroach into HOA land & a drainage easement and therefore were not permitted to
build. Michael Arellano, the Chief Building Official is out of the office today and will be back
tomorrow. George Marshall of our Engineering Department is familiar with these requests, but
he too is out of the office. I am copying them on this email for them to respond to you. Please
let me know if you haven't heard from them by Thursday.

Hi. I am pretty sure you are the gentleman whom I spoke with at the city regarding the original
approval on this stucco home. I am the HOA president here at Windsor Estates and I also sit on
the architectural review committee for our neighborhood (ah, the joys of living in a tiny
subdivision, you do everything). Anyhow, I am wondering if you also received the plans for the
proposed pergola for 917 Deforest. Do your plans show any part of this pergola infringing on
either HOA owned land or city restricted land? They gave me a small portion of the whole plat
and I can't tell. I am thinking they may try to "pull" something as this has been an ongoing
battle with these people. I can't approve something to be built on land that they don't own for
many reasons. Can you help me figure this out? I know you spoke with my husband, Tim
Johnson, about this particular property and their desire to purchase the HOA owned portion
(which we denied).

I am going to have someone drop off 2 copies of the Pergola for 917 Deforest for
review. I am also dropping off a set for the city as well. If you could please look
them over and let us know if you have any questions. I will be out of town all next
week, but you can call Dean Trudell if you have any questions, or when it's
approved. His number is 469-446-1166. I know as soon as the city approves it
Dean will be ready to build.
