I am very very confused.  In the attached memorandum it is stated that if the brick screening wall is included the City would remove from the plans the wood fence at $30/lf and the pedestrian handrail at a total cost of $102600, this seems to include 1100" of fence repacement.  Yet in your email below in paragraph 2 you state the intent of the project is not to modify the fence.  Regardless we will need to consult because if  the fence is in the public right of way how could it possibly be the responsibility of the HOA.                 In a message dated 4/4/2011 11:36:38 A.M. Central Daylight Time, gmarshall@coppelltx.gov writes: Mr. Miller,   I am the project manager on the Deforest Road Reconstruction project.  Adjacent to your property, the new roadway top of curb elevation will be approximately the same elevation as the centerline of the existing asphalt street.  Due to the elevation difference at the ROW line we will have a 1.5-2' retaining wall just off the back of a 5' sidewalk. The wall will rise from the sidewalk and meet natural ground.  The distance from the back of the retaining wall to the wood fence is between 1-2 feet.   The intent to the Deforest project is not to modify the wood fence.  The entire length of wood fence will remain in place and ownership will remain in the HOA.  During construction the contractor may need to remove a panel of fence here or there but will put it back once complete.  If during the course of construction part of the fence is damaged by the contractor then they will be responsible for repairs to the fence.    As discussed in earlier correspondence with the HOA the City would be willing to try to accommodate the HOA in the replacement of the wood fence with a brick screen wall during the course of the Deforest Road project, if the HOA would pay for the additional cost.  A letter with a rough cost estimate was sent to the HOA in July 2010 with notice that we would need to know as soon as possible so we could incorporate the screen wall in the engineering plans prior to 100% design.  The anticipated additional cost was $550,000.   Since no response was sent back to my office, our design consultant continued with the final file://C:\Documents and Settings\radloo\Local Settings\Temp\XPgrpwise\4DB843EACity...10/31/2011 Page 5 of 8 design of Deforest and now is nearing 100% complete plans and bid specifications.   After talking with the HOA management company on Friday, I have learned that they apparently never received the letter.  Since we were planning on going to bid very soon, we have decided to hold off on the bid so the HOA can have discussions about the screen wall.    Thank You, George       George Marshall, PE City of Coppell Engineering 972-304-3562 >>> Ken Griffin 4/1/2011 10:42 AM >>> George   Could you address these issues?
