Attached is the latest draft of the Economic Development Incentive Agreement with CSE
Commercial Real Estate LP.
We incorporated many if not most of your requested changes from your red line. This
document is our last draft of 7-5-08 with the changes should in red line strike through and
underline. Please note that this document has not been reviewed or approved by then City
and is subject to change.
Among other items we added a definition of “Substantial Completion”. The definition of
Expiration Date remains as there must be a termination date even if there is no
requirement to complete the Project within 10 years. We need some language prohibiting
fast food restaurants and added first attempt at such prohibition. Please note that the
Company must construct the Town Square Improvements since the City is subject
competitive bidding. As to Way Finding Signs, the City had already paid for the signs
and if the Company wants to change the name such costs will have to be paid by the
Company. The rest should be self explanatory.
The Option agreement and Easement Agreement will follow by separate email.
