A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, AUTHORIZING RELEASE OF A STREET ASSESSMENT FOR AND IN CONSIDERATION OF THE DEDICATION BY THE PROPERTY OWNER OF A PERMANENT TEN FOOT UTILITY AND SIDEWALK EASEMENT; PROVIDING FOR EXECUTION OF A RELEASE UPON RECEIPT OF AN EASEMENT DEED; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, by Ordinance No. 90472, dated April 10, 1990, a street assessment was levied against Northlake Nursery and Landscape Company, owner of a 4.43 acre tract of land at 794 Denton Tap Road, Coppell, Texas, in the sum of $17,560; and WHEREAS, the assessment has not been paid in full and the City is desirous of acquiring a permanent ten foot utility and sidewalk easement from the property belonging to Northlake Nursery and Landscape Company; and WHEREAS, the parties have agreed that it is reasonable that Northlake dedicate the easement to the City in exchange for a release of the street assessment; NOW, THEREFORE, BE IT RESOLVED BYTHE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That upon delivery to the City of Coppell of a permanent ten foot utility and sidewalk easement deed from Northlake Nursery and Landscape Company to the property described in Exhibit "A" attached hereto and made part hereof for all purposes, the City Manager be, and he is hereby, authorized to execute a full release of the certificate of special assessment authorized against the Northlake property by Ordinance No. 90472. To The City Manager Chad Beach, Tax Assessor/Collector January 24, 1994 Market Value of North Lake Nursery According to the Dallas Central Appraisal District, the North Lake Nursery site consists of 4.43 acres valued at $1.23 per square foot for the 1993 Tax Year. However, I would like to point out, .8092 of an acre was sold out of the property adjacent to the North Lake Nursery site on the north side during February, 1993 to Gregory & Cathy Gemoules for approximately $2.84 per square foot. LOUIS NICHOLS Dear Mr. Trando: Enclosed is the original and two copies of a Resolution which would authorize release of the street assessment against Northlake Nursery and Landscape Company levied by Ordinance 90472, in exchange for an easement deed to the ten foot utility and sidewalk easement described in Exhibit "A". We do not have any information about the relative values involved, but I assume you have information that the easement and the cost of its acquisition through condemnation would equal or exceed the amount of the street assessment being released. I do not know the relative land values in the area, but for the amount of land being acquired by the easement, it appears to me to be a fair exchange, given the exorbitant costs of acquiring property by condemnation.
