Casey,
Good timing, and good news - just received, opened, and read the attached letter.
I believe the second paragraph of the letter contains language USFWS has come up with as their "form letter" to
which they previously referred. They send this type letter out as their response to requests such as the one we
made. From what I've gathered, a biologist has to complete an assessment and conclude there will be "no effect",
and if they agree, they will issue this letter. (FYI, the "other" form letter conveys USFWS will not make a call,
and that Endangered Species Act compliance is the responsibility of whoever made the request (a biologist needs
to be hired to complete an assessment and make a call.)) What you were told would be required by FEMA and
what USFWS presents is required don't exactly jive, but that's not unusual. I realize the bottom line is you have
to make FEMA happy. As USFWS presents, this is as good as it gets, and according to them, with regard to
FEMA, "it's been working so far". What they present - that a "no effect" determination does not require Section
7 consultation is correct; in fact, we do not want Section 7 consultation, as that typically take place when there's a
problem or a potential problem. As they also indicate, documentation we provided should me maintained by
USFWS (we've done that) and FEMA (you will have done when you provide my report and this letter to FEMA).
We're glad to have been able to wrap this right up for you guys.
