If I'm reading the agreement correctly, it looks like you need to email Patrick McInroe at
patrick.mcinroe@luminant.com<mailto:patrick.mcinroe@luminant.com> with a copy to Paul Martin at
Vinson and Elkins (pmartin@velaw.com<mailto:pmartin@velaw.com>) and Andy Wright at
awright@energyfutureholdings.com<mailto:awright@energyfutureholdings.com> with your notice of the
day you want to go. You need a minimum of 48 hour notice. Please copy Ken and me.
Since I'm guessing none of the 3 will be the ones to actually let you in at the site, you'll have to ask them
whom you should coordinate with for instructions to enter the site.
The agreement says you have to be between 9 and 5. If you'll need more than one day, let them know.
Provide them a brief description of your planned schedule and activities.
Ken, if you see anything I'm missing, please let us know.

It is my understanding that I need to coordinate with you in regard to access to the North Lake impoundment.
The purpose of the site visit would be to conduct a preliminary jurisdictional determination (JD) of existing
waters of the U.S., including the documentation of inflows, the functional outflow, and the receiving water
body. I am hoping to conduct the site visit/JD next Tuesday (December 24). The site visit would likely take a few
hours, depending on access around the perimeter of the impoundment. The data I plan to collect will be
needed for our consultation with the U.S. Army Corps of Engineers (USACE) when discussing options for
lowering the conservation pool and re-establishing jurisdictional limits.
Please let me know if a site visit next Tuesday would be possible, as well as who I would contact for actual
entrance to the site.

They made their site visit to North Lake the other day and everything went well on that. They're pulling
together their information and trying to set up a visit with the Corps to try to get a handle on exactly how
far we can go to reduce permitting efforts. The schedule for development is to have the lake lowered and
some edge work done to allow development of their Phase 2 in Nov. of 2013. I don't know how that fits
the City's schedule, but to match it would mean starting construction in the fall of this year to lower the
lake, which backs into starting the field exploration and the design this spring. Those are general dates
without any scheduling effort behind them. I wanted to start the discussion about how the City wants to
proceed and thought it might be helpful for me to come to your office to meet and go over the next phases
and make sure I understand the City's commitments and constraints and how you want to proceed. Next
week, I'm available Tuesday 2:30 or later, anytime Wed, and Friday afternoon. Would any of those times
work for you?
