Parcel 4 - Permanent Right of Way
Dear Mr. Tate:
Thank you for taking the time to talk to Keith Marvin and Michael Garza regarding the
purchase of the portion of your land needed to construct Freeport Parkway. Just to
refresh your memory, this project will consist of removing the current asphalt roadway
and constructing a four lane divided roadway. The project will involve the reconstruction
of the bridge over Cottonwood Branch, the extension of a 12" water line, improved
drainage, and an 8' hike and bike trail from Sandy Lake Road to Wagon Wheel Park.
In January 2009, the City of Coppell sent you an offer letter regarding the purchase of a
portion of your land for permanent right of way for the construction of Freeport Parkway.
The project was delayed for a couple of years, but we are now back on track and moving
forward with the project.
With this letter I am attaching several documents. The first is a copy of the Texas
Landowner's Bill of Rights. This document outlines your rights as a land owner with
respect to the city's acquisition of a portion of your land for permanent right of way. I
also included a copy of the plan sheets for the roadway construction adjacent to your
property. Finally, I am including the right of way documents themselves.
Parcel 4 consists of 7,579 square feet of land. The city's typical approach to purchasing
land from adjacent property owners is based on the value determined by the Dallas
County Appraisal District. The appraisal district lists the value of your land at $2.75 per
square foot. The current appraisal reflects a 70% reduction in value due to the floodplain
encroachment. The portion we are interested in is not in the floodplain, and we are
therefore considering the full value. The City of Coppell will offer you $20,843.50 at this
rate (7,579.44 square feet x $2.75/sf) for acquisition of the portion of your property
depicted in the attached exhibits.

Acquisition of this property and construction of the roadway also necessitates the
removal of a small garage structure that lies partially within this area. As discussed, we
will remove the building and offer you $10,000.00 as compensation for the loss and
remove the water well and compensate you $5,000.00 for the loss.
We will also provide you a new driveway and parking area in the location shown on the
attachment per your request. This is valued at approximately $19,000.00 and will be
constructed by the city with the street construction. We will also extend water service to
your property and offer you $1,100.00 to cover the cost of the water impact fee.
The transfer of mineral rights is not included with this right of way purchase. Any
mineral rights owned by you on this property will remain in your possession.
Construction is scheduled to start during 2012, and the city needs to acquire this property
as soon as possible.
If the above offer is acceptable, please sign below and return the letter to this office.
Once the letter is received, the process for payment of the $36,943.50 can start. Your
consideration of this matter is appreciated, and if you have any questions, please contact
