visit about this as I do not want to create for them or cause us to have major surprises and

Hi Clay:
I met once more with the franchise utilities and Freese last Friday. The
question came up about placing city utilities in the rear. Without
announcing to a room full of people my concerns, the primary reason I'm
reluctant to place the water and sewer services in the rear is the
possibility for conflict with franchise utilities and storm water.
Because we are reacting to the City's decisions and not our own recommended
plan of splitting the design concurrently, I am very concerned about storm
water management in the residential alley and especially in the retail
services block. Because the City will be working ahead of us instead of
together, there is a potential for problems we will encounter during
construction because of this stutter-step process.
For instance, if we incur a cost to relocate City water and sewer lines to
make our storm drainage work, we are going to be very upset because we have
no way to anticipate those costs. Unless Freese & Nichols is comfortable
this will not occur, we need to address this with the City before the design

As you are very aware of by now, I am a very cautious planner and since this
deal is very difficult to navigate, we don't have room for an expensive
planning error on these sites. I know the City's own budget exceeds the
original plan as well and we want to do all we can to be agreeable and watch
costs for everyone.
It's really out of bounds for me to tell the City Staff where public
utilities are placed. Ken even told me a year ago I needed an engineer to
help me through this process and I couldn't agree more, but the engineers
started without us and we have to trust their decisions. It's almost as
though Charles and I need to hire Freese to study their own plans for the
City to tell us if they will actually work for our development without
conflicts.
If you are concerned at all that we will be facing construction conflicts,
we need to somehow address it.
