Date: 9/29/2011 9:20 AM Subject: RE: Time Warner Cable On every project we've built on Denton Tap, we provided conduit for TWC. In every case, they told the first tenant who called them it would cost $1000 to $1500 to get service because the customer would have to install the wire. I don't know if they do that to homeowners, but none of my office users ever subscribe for this reason. If you want us to talk to TWC, we can do so, or if you want to set up something with staff, that's fine as well. Gregory K. They have the right to use out rights-of-way and can actually come in after the fact. Our experience is that when that happens with any utility, they really make a mess. Perhaps approaching them to see if they are willing to pay for it, or in the alternative, sign a binding agreement that they will not pursue business in the area makes sense. The only issue I see with that is what do we do when a subsequent homeowner requests services from them. Clay >>> "Greg Yancey" <gregyancey@verizon.net> 9/28/2011 4:14 PM >>> Hi Clay: Unless the City has a contract requiring Time Warner in our project, we want to eliminate their $50,000 conduit or give them the option of paying for it. I spoke with another developer two weeks ago and he said they wouldn't (11/30/2011) Ken Griffin - RE: Time Warner CablePage 2 even go into his last deal against FIOS. Can we eliminate this? If so, we have to delete the word "cable" from the private infrastructure definition as we complete these amendments. Thanks, Gregory K.
