Yes, our contractor will be responsible for any damage. Please note that
we are adjusting the rock wall approximately 1.6' in order to fit the 6'
sidewalk behind the back of curb.

Okay, just to be clear, the contractor, in the contract documents with
the city, is responsible for "restoring" the area to original condition.
If there is damage to the sign, or the rock area surrounding it, or the
landscape, the contractor is responsible for restoring, correct?

Mr. Turner,
Please see the attached sheet. This is the design plan sheet in your
area. We have a note to modify the wall around the sign. At this time, I
don't believe we are modifying the sign itself but the contractor will
be responsible for restoring the area to original condition. As far as
the easement goes, we don't need to address the sign specifically.

Hello George.
Question. As I recall, wasn't there is a need to remove a portion of
the existing rock base of the sign, and some landscape? I think it
might be the State Farm sign. Can you confirm, what improvements, if
any, will be disturbed?

No problem whatsoever.
Per my previous discussions last year (with the intern that was handling
this, I think), I do not want to have any liability for the maintenance
or repair of the retaining wall, or any other improvements constructed
by the City. That being said, I believe this can be accomplished by
changing the word "GRANTEE" in the last paragraph, to "GRANTOR", where
it states,
"GRANTEE shall not be obligated for future maintenance and upkeep of the
surface area", to read:
"GRANTOR shall not be obligated for future maintenance, repair and/or
upkeep of the surface area or any improvements constructed thereon in
connection with the grant of this Easement."
My reason for this is that at least one time in the past, a car
traveling on Denton Tap has jumped the curb and damaged the property. I
lost a tree at that time. I don't want to be responsible for repairing
or replacing a retaining wall or sidewalk that I didn't pay for in the
first place, in the event a driver is uninsured or that I am otherwise

unable to collect for damages.
I'm granting this easement without any compensation (other than the
nominal statement of $10, so this addition can be the "other valuable
consideration".
