Dear Mr. Elium:
Please refer to my letters of June 8, 1981 and July 1~, 1981.
Assume the City is agreeable to bearing the cost of the cross-
Lug since work is being performed within our right-of-way. Therefore,
you will find attached duplicate origioals of proposed agreement.
After execution on the City's behalf, return both copies along with
copy of the City Council's motion or resolution authorizing accept-
Rnce Rnd execution of the agreement to me for further b~ndling.
Again, I remind you that no work is to be performed within our
right-of-way until the agreement has been handled to conclusion.
There have been reports that the main line has been fouled
by your contractor. The flange ways were so fouled on July
1981 that if a train were to pass through, it would have definitely
derailed. The City of Coppell will be held responsible for -ny
accidents occurring out of such incidents.
