Box 478 Coppell, Texas 75019 RE: WEST SANDY LAKE ROAD PROJECT # ST 99 -02 (TNP Project No. CPL00243) Dear Ken: The enclosed Modi ation to the Scope of Services for the referenced project has been prepared, per our dis ssion with you last month, in accordance with the applicable provisions of the Consulting Engin ers Contract. Please allow this letter to serve as our summary of justification for the attach d modifications. I. Project Schedule a. Original Schedule In Based upon the contract nguage, it was generally understood that time was to be of the essence, and a prod ct schedule was developed to achieve the City's goals. Portions of the established sc edule are itemized generally as follows: • Preliminary design of 7 p ses 1 and 2 were to be completed in 2002. • Final design for Phase 1 ould continue until completion in early 2003, with bidding and construction fo Phase 1 to take place from mid -2003 until mid - 2004. • Phase 2 final design was sche led to begin and be completed in mid -2003, with bidding and construction to to ace from mid - 2004 to mid - 2006. b. Revised Schedule Intent Due to the need for a more fiscally conservative approach to the sale of bond funds, the City determined that the design and construction schedule for the project would be delayed. At the present time the following is a combined actual and projected timeline: • Preliminary design of Phase 1 was authorized to begin in early 2003, and preliminary design of Phase 2 is projected to begin in mid -2004 and end in early 2005. • Final design for Phase 1 was authorized to begin in early 2004, with bidding and construction for Phase 1 to take place from late 2004 to late 2005. • Final design for Phase 2 is projected to begin early 2005, and end in late 2005, with bidding and construction to take place from mid 2007 to mid 2009. 12160 North Abrams Road, Suite 508 • Dallas, Texas 75243 • 214.461.9867 phone • 214.461.9864 fax www.tnp- online.com The attached Gantt chart graphically depicts the shift in schedule for the above described project elements. As can be seen, delays in anticipated labor efforts typically range from one to three years, depending on the phase /task of the project. These delays have resulted in, and will continue to result in, increased operation and labor costs for TNP and its subconsultants at each stage of the project that is beyond the originally intended timeline upon which design fees were based, as well as cost associated with additional effort to remobilize our design efforts after lengthy periods of inactivity on the project. II. Scope of Work a. Roadway Section The project was to be designed as a 4 -lane roadway, from Denton -Tap Road to State Rd. /Freeport Parkway and a 6 -lane roadway from State Rd. /Freeport Pkwy. to S.H. 121, with a dividing median where possible to create a boulevard street section. Also to be included was a 2' wide on- street bike lane in each direction of travel for the entire length of the project. However, at the beginning of Preliminary Design, the proposed roadway section was modified by the City to reduce the 6 -lane section to a 4 -lane section with a wide median for future expansion to 6- lanes, and reduce the pavement width to eliminate the on- street bike lane. The subsequent revisions to previously agreed -upon pavement limits, centerline alignments, etc resulted in additional re- design costs. b. Existing Conditions Due to the aforementioned schedule delays, existing physical conditions of the project site had to be verified once the Phase 1 preliminary design was authorized, and it was determined that the conditions had changed. Thus, re- survey and additional design efforts were required to account for new developments that had occurred during the delay or that were in the planning stages, such as Coppell Bible Church, Amberpoint Development and the proposed warehouse facility. Additional efforts included updated tree and topographic surveys, locating platted property corners, re- evaluation of drainage areas and existing utilities, coordination with developers, sidewalk revisions, and additional driveway /median considerations. C. Funding Participation by Dallas County The City informed TNP that it has secured partial funding from Dallas County for the construction of Phase 2, which will necessitate that TNP and the City follow standard County meeting and documentation procedures. Thank you for the opportunity to meet with you to discuss these matters, and allow us to pursue this contract amendment that would provide for an appropriate fee adjustment for TNP and its subconsultants. Project Schedule The project schedule shall be modified according to the Actual and Projected timelines as shown on the attached Gantt chart. If significant changes occur to the new schedule, then additional contract modifications will be necessary. Generally, the new timeline goals are as follows: Complete Phase 1 Final Plans Begin Phase 1 Construction Phase 2 Preliminary Plans Phase 2 Final Plans Phase 2 Bidding /Construction August 2004 4 th Quarter 2004 3r Quarter 2004 — 1 st Quarter 2005 2nd Quarter 2005 — 4 th Quarter 2005 2007 -2009 II. Scope of Work a. Roadway Section The project will be designed as a 4 -lane divided roadway, from Denton -Tap Road to State Rd. /Freeport Parkway and a 4 -lane divided roadway from State Rd. /Freeport Pkwy. to S.H. 121, with a wide dividing median to allow for a future 6 -lane divided roadway section. b. Existing Conditions TNP shall confirm existing conditions of project site upon authorization to proceed with design of each phase, including re- survey of platted boundaries, and associated improvements. TNP shall design drainage systems, utility relocates, and driveway /median openings to accommodate relevant new developments that occur during significant project time delays. C. Coordination with Dallas County TNP shall coordinate as necessary with Dallas County during the design and construction of Phase 2, including necessary meetings and documentation. Design and plan preparation standards, including design software, shall remain as those used in Phase 1. III. Compensation The Engineer shall be paid an additional lump sum fee for the above described Additional Scope of Services in an amount of One Hundred and Fifty -three Thousand, Four Hundred and no /100 Dollars ($153,400). This amount includes the following increases: Engineering Design & Construction Services: $122,100 Design Surveys (Incl. Tree Survey): $2,400 Property Surveys & RNV -Esmt.
