Re: Leslie Tract Development Coordination — NEC of Belt Line Road and
Hackberry Road
Dear Mr. Ramsey:
As you develop your property in Coppell, which is adjacent to Billingsley
Company's property in Dallas, Billingsley has requested the following provisions
as it affects Billingsley Company's. If you agree with these provisions, please
sign the acceptance block below and return to me:
Storm Drainage:
It is understood that the Leslie Tract plans to drain storm water onto Billingsley's
property to the north. The Leslie Tract development shall:
Detain all developed drainage flows to match current undeveloped
conditions.
Release concentrated detained drainage flow, calculated to be 85 cfs, at
the northeast corner of the Leslie Tract (see attached Exhibit A).
It is recognized that temporary grading will be required on the
Billingsley property to accommodate that flow, but note that a permanent
easement is not anticipated. You shall comply with the following:
a. Construction will be for grading purposes only. You will
provide appropriate erosion control and restoration of disturbed
property.
b. The temporary grading will follow the limits of grading and the
amount of grading as shown on the Pacheco Koch Consulting
Engineers plan dated September 09, 2011 (see attached Pacheco
Koch plan).
c. You will also contact James Lockridge at (214) 500 -0871 prior
to construction to assist in the protection of livestock on
Billingsley property.
d. You will provide temporary fencing during construction
adequate to control livestock.
e. You will provide full restoration of the property fence after
coordination with James Lockridge and disruption of the
property fence is complete.
f. If any issues arise with the livestock on Billingsley's property
(i.e. livestock exits premises), then the Leslie Tract will be held
liable.

g. Grading and full fence restoration must be complete by midnight
on January 31', 2012, subjec=t to force majeure or delays caused
by the City of Coppell
h. You will provide Billingsley Company a post construction
Record Survey of the improvements on Billingsley's property
and upstream 50 feet within your property.
4_ Provide an appropriate storm water quality control device via a dry
detention pond for all drainage from gas stations and other individual
developments on the property.
W ntowater:
The City of Coppell is requiring the wastewater flow generated from the Leslie
Tract and from Billingsley Company's property be combined into one (1)
wastewater line for one (1) bore crossing across Belt Line Road in lieu of two (2)
separate bore crossings. It is anticipated that Billingsley's property will generate
approximately 1250 GPM and is to discharge into the City of Coppell system in
Belt Line Read. According; to your Engineer's calculations, it is anticipated that
the Leslie Tract will generate approximately 536 GPM, and is also to discharge
into the same City of Coppell system in Belt Line Road. The Leslie Trace will
retain the right to arzv excess sanitary sewer eapacity above the combined 1250
Cif M from Billingsley and 536 GPM from the Leslie Tract projected to ,Flow
through the propmed 15 " line.
Billingsley Company plans to tie its wastewater main into the Leslie Tract
wastewater main at a manhole installed by the Leslie Tract as shown on attached
Exhibit B. The downstream wastewater main after the combined flow of 1250
GPM and 536 GPM will need to he a 15" wastewater main in lieu of the 12"
wastewater maim that is currently proposed by you. This 15" wastewater main
will extend ±430' north along Belt Line Road, then bone across Belt Line Road to
an existing manhole at an existing 15" City of Coppell wastewater line (see
attached Exhibit B). Billingsley Company will agree to pay for one -half the
actual cost of this construction downstream of the shared manhole, which total
cost is estimated to he $50,182.50, based on your OPC dated September 2, 2011.
In the event Billingsley has to construct this downstream connection due to
schedule requirements, then Billingsley will utilize the Leslie Tract Engineer's
City approved plans for construction, and you will agree to reimburse, at time of
connection, one -half the cost of actual construction of this downstream
improvement. You will not he responsible for the sanitary sewer design within
Billingsley's property or obtaining permits to allow Billingclev's use thereof
