Dear Mr. Swihart:
As required in the Special Condition #1 of the U.S. Army Corps of Engineers
(USACE) permit letter dated May 4, 2005, the following information is submitted
for your records. This letter constitutes the fifth annual written compliance report,
due October 1, 2009.
Construction of the remaining gabion structures commenced in late 2008 and was
completed along with the mitigation vegetation by July 2009. An assessment of the
mitigation vegetation was conducted on July 2, 2009. The results from the July
2009 assessment for canopy trees and small trees and shrubs are included on Tables
1 and 2, respectively.

Of the tree and shrub species observed, only 64 percent of the species were showing
active growth. Two species, black walnut and rough -leaf dogwood, were not
observed; however, black walnut species could have been mistaken for young pecan
observed on -site. The City of Coppell is discussing mitigative measures to rectify
the insufficient number of species observed. The mitigative measures taken to bring
the permit into compliance will be detailed in a subsequent letter to your attention.
